WIth regard to the stimulus plan, the tax tables are changing in April so that most people will have less withheld from their check. The result of this is that you will likely end up in a higher bracket next year and have to pay in more. You might think about changing the number of deductions on your W-4 to minimize the impact.

Richard,

The withholding tables have nothing to do with what tax bracket you end up in. Please don't spread this inaccurate rumour. Your taxable income is not affected by how much tax you pay in during the year. Maybe I'm not sure what you meant. Please elaborate.

This credit is confusing to many so I'll explain it here.

It's called the Making Work Pay Credit and it is a refundable credit of up to $400 for single filers and $800 for married filing joint filers.

It applies to individuals who are employed or self-employed. If you make more than $75k (or $150k if married) the credit starts to phase out. It's totally gone at $95k/$190k.

This credit will be delievered to you early as an increase in your paycheck via a reduction in income tax withholding. This will start in April, I believe. The credit will then be claimed on your 2009 return. However, because it's being paid early to you through your paycheck you won't see any increase in your refund. You'll have already received it. Of course, if you are self-employed you don't have a paycheck but will get the credit through your tax return as a reduction in your tax liability.

Credits do not affect the tax bracket you are in. I repeat, TAX CREDITS DO NOT AFFECT THE TAX BRACKET YOU ARE IN! You cannot affect your taxable income by changing your withholding.

Do I understand correctly?

My husband and I both claim 0 for withholding. If I understand what you are saying, we will get a total credit of $800 and it will show up as $800/12 per month.

In 2010, when we prepare our taxes, will this amount be shown as an amount "owed" in taxes? Like I was given a loan for 2009. My taxes are not reduced, I just was able to use that money in 2009?

We have not received money back for years and have to pay in every year. I hope I will not be paying this money in also???

Partly yes and partly no. You will receive the 800 (assuming you meet the income limits) and it will come out of your paycheck-starting April, I think. But it is not a loan. When you do your 2009 tax return there will be a credit which lowers your tax liability. But since your withholdings will also be lower than in previous years, you won't really see an increase in your refund or a decrease in the amount you owe. At least those things won't be due to this credit. You still are getting a tax benefit, you just get it early.

Seems like an odd way to send that out. Is anyone really going to do anything differently with an extra $15 in their paycheck? If you sent out $400 in a lump refund like that last one people might go out and buy something. $15 every two weeks doesn't sound very...stimulating.

Actually, Levi, financial experts says that people are more likely to spend minor amounts of extra money than they are bigger windfalls. Psychologically, a big windfall feels more like something special that needs to be saved. But getting 15 bucks in your paycheck is no big deal and you spend it.

I am suffering from a broken window pane in a window that I have a quote will cost $850.00 to fix. I heard a commercial on the radio this morning that stated that the stimulus plan offers a $1500.00 tax credit that can be used to repair windows. Will you proofcheck this for me, please?

Mike,

Yes, there is a credit for energy efficient improvements to your home. It's called the Nonbusiness Energy Property Credit. This credit's been around for a few years although it was suspended in 2008 with regards to windows and doors. It's been reinstated and the total credit available is 1500. I haven't been able to find real specific info about any limitations. The previous law limited the window credit to $200 but I'm not sure about the new law. The windows must either be manufacturer-certified to qualify for the credit or you can rely on the EnergyStar certification. The credit is definitely for total window replacement not just pane repair and it applies to your home, not business property.

We used the credit for windows last time we replaced five of ours. They were thermal pane and definitely more energy efficient than the old ones. Must have been about 05.

Medical expenses are part of the itemized deductions on Schedule A. They have a 7.5% floor which means that you must reduce the expenses by 7.5% of your gross income and whatever is leftover is deductible on Sch. A. If you can't itemize then none of your medicals are deductible. Don't forget that medical premiums are also medical expenses, as well as vision and dental costs. If your employer runs your medical premiums through a cafeteria plan (also known as a section 125 plan) then you can't use them for the deduction because you are already getting a tax break on them.

Richard, in case you don't read Bob L.'s posts anymore I'll answer your questions again and, I hope, clarify things.

2. True or False: If the answer to #1 is True, then doesn't it follow that this time next year my W-2 will show a higher income? NO. Box one of your W-2 reports your gross wages before any deductions other than certain pre-tax employee benefits such as 401k contributions or cafeteria plans. You are taxed on your Box 1 amount. If you match your W-2 with your paycheck stubs you will see that your federal withholding has nothing to do with Box 1 wages.

3. True or False: If #2 is True, then isn't it more likely that I will have to pay in because my income is higher and I am under-withheld this year? No, because your taxable income starts with your gross income which is not lowered by your federal tax withholdings.


4. True or False: If I change the number of deductions on my W-4 I can correct the under-withheld condition so I don't have to pay in so much next year? Sure. If you routinely have tax owing and want to correct that you can change your withholdings on your W-4. Conversely, if you get a big refund every year and want to get more in your paycheck your can increase your exemptions on your W-4.

The IRS does not allow taxpayers to manipulate their taxable income by have more federal tax withheld. One more time I will say that your federal tax withheld is not a deduction from your taxable income.

October 8,2008...former president George Bush signed into law the *extension* for the bill allowing for INCOME TAX DEDUCTIONS for....energy efficient home and business expenses......such as......efficient water heaters......energy efficient window replacements.....etcetera. I'm not even sure what you're talking about here. Of course there are legitimate deductions allowed. I haven't said that there weren't. I've only said that you can't deduct your withholdings. By the way, if you think there are legitimate deductions, doesn't that assume that the tax structure is valid? There can't be legitimate deductions to determine a tax that's illegitimate. You best take a class on logic and circular reasoning, Sir.


The Sixteenth Amendment states:
The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

Seems pretty clear to me.

JCF: WOWOW,what bitterness you maintain. You are however QUITE wrong. I was never in a federal prison. I was *illegally* detained (as can be read from the RECORD of the case in the James F. Battin federal courthouse in Billings) while I was being processed to the federal court- - - -where I was ACQUITTED by the HIGHEST RANKING law official in the entire State of Montana.......the Honorable Richard F. Cebull....Chief Federal Judge for the Federal District of Montana...who also sentenced my cellmate.....(no name being necessary here)......to.....two hundred eighty (280) months in federal prison for massive methamphetamine dealing.
JCF..........because I know you will need this......280 months is 23 years and 4 months.........i.e., 280 divided by 12 months per calendar year............duh?

FYI..........now the federal government.........by STATUTE and provision of LAW............owes me $33,000 for loss of income + $65,000 for necessary attorney fees and lawful representation in the federal court system + "whatever is deemed reasonable by statute" for stress and duress for their (IRS and DOJ) having incarcerated me and tried me for a crime I did not commit. FYFI (for your further information) the sections of federal law and CFR (code of federal regulations) which define all this is under the sanction of FTCA........federal tort claims act.
You,Sir or Ma'am, could be of great assistance if you chose to be. You could decently assist me as an American Patriot having been illegally indicted,illegally arrested,illegally detained......by FALSE information and ILLEGAL means crafted by and from the IRS........if you wanted to help me file all the necessary legal forms and documents it will take for the next year and a half to recover this $100,000 and some...........ok? Ship, I'm glad to see that you live in the TRUTH. Your life must be very difficult given your position. Because you choose not to fulfill your lawful obligation to pay taxes I assume that you are also not partaking of the benefits others have made possible. For if you do, you are a hypocrite. For example, you probably don't drive on the interstate highways because they are funded by federal dollars. You probably can't take any medicines because often the research used to develop them relied on federal funding. You probably have to grow all your own produce because farms are subsidized by the federal government. You can't ever visit our wonderful national parks or monuments because they are maintained by federal monies. And you can't use the library because they get federal grants.

I got it! I have been fretting over who will do my taxes this year... I'm not going to. I'll just tell em Ship don't, I ain't either. That should work--right?! According to him, we don't have to, and he's a model citizen...and maybe then we could all get on the no-tax-paying bandwagon, and send 3000-some-letters to every citizen in Miles City. Whew, this will all be done in between fighting off wild child eating mountain lions and replacing all the windows in my house...and charging the government for it. Let's all start changing our windows, hot water heaters...go green!!! While not paying taxes...and then get the tax credits for it! Ingenious sir...Ingenious...

I found this online on the Ludwig von Mises blog (http://blog.mises.org/arc...006190.asp).

The post is in response to a story about a man from New Hampshire named Ed Brown who vowed to shoot tax collectors back in 2007. Mr. Brown stated that he would never be taken in alive.

I'll give you three guesses as to who the author of the following post is. As a hint, I've highlighted some of the best parts for your enjoyment.

I have not filed an UNCONSTITUTIONAL IRS form 1040 since 1976 and I never will.
IRS has been now six (6) years trying to extort $200,000 from me and they cannot get a dime.
I do not have an attorney nor a CPA and have defied all these atheists and communists SUI JURIS with my computer and Holy Bible and U.S. Constitution.
Ed and Elaine Brown are wonderful Americans and should be loved and adored and applauded every Fourth of July.
The *IRS* is a mere Third Party collection agency for the BMITW..........biggest mob in the world.........the 12-member International Banking Cartel.........in London,England.....who owns the Federal Reserve as a "private closely held banking entity" as per listings in Dun and Bradstreet.
Corporate Income Tax is LEGAL as per legislation of the U.S. Congress...........personal income tax is neither legal nor passed by U.S. Congress legislation.
You fools that pay income taxes are traitors to your own country and deserve to be summarily deported for your nonchalance and stupidity and despicable gutless wonder.
The IRS can have my Lincolns and diesel 4x4s and home and businesses and money...........anytime they can pry it all out of my cold dead fingers.

Please give me an instance when the U.S. Supreme Court has ruled that the Internal Revenue Service is unconstitutional.

I don't even need an example of when the IRS has been shown to be "25000%" unConstitutional. I'll be satisfied with a burden of proof of exactly 100%. (See, I'm making it easy for you).

That is, of course, unless you believe that the SCOTUS is also unconstitutional. If that's the case, I guess we'll just have to agree to disagree.

Forgive me if I pay more heed to the justices of the Supreme Court than I do you when it comes to matters Constitutional.

Sorry...just re-read the mumbo-jumbo from above... He danced around the issue with verbage and intelligence. And I have formed my own opinion, the man should move to Canada. I think both Miles City and Mr. Shipley would be much happier.

And, BTW... once you have an email set up from a university I believe you can continue to use it after you are no longer a student etc. It's free anyways, why would it be freeloading? I have many friends that still use MSU email's that were established when they were students. I could be wrong though, it just doesn't make sense that the day you graduate or discontinue to work there, they cancel your email account, it's like msn or hotmail cancelling your email when you do not request them to...

Correction needed: I am not a CPA, I have never been a CPA. I am
an Enrolled Agent and the two day exam I took was 100% tax related. I am also an attorney although I haven't practiced in years.

Just out of curiosity, is swearing still swearing if it's written in Morse code?

Larry - if someone were to post a Morse code sample of a particular email that a particular person may or may not have sent another person, and said email contained language that would shock the saltiest sailor, would the offending words need to be censored in the Morse code, too?
