I was recently informed that my employer was going to direct deposit and I was wondering what my rights are regarding payroll and direct deposit ... could I ask for it to be mailed instead ??? thanks for the input...

MCA 39-2-204

39-3-204. Payment of wages generally. (1) Except as provided in subsections (2) and (3), every employer of labor in the state of Montana shall pay to each employee the wages earned by the employee in lawful money of the United States or checks on banks convertible into cash on demand at the full face value of the checks, and a person for whom labor has been performed may not withhold from any employee any wages earned or unpaid for a longer period than 10 business days after the wages are due and payable, except as provided in 39-3-205. However, reasonable deductions may be made for board, room, and other incidentals supplied by the employer, whenever the deductions are a part of the conditions of employment, or as otherwise provided for by law.

(2) Wages may be paid to the employee by electronic funds transfer or similar means of direct deposit if the employee has consented in writing or electronically, if a record is retained, to be paid in this manner. However, an employee may not be required to use electronic funds transfer or similar means of direct deposit as a method for payment of wages.

(3) If an employee submits a timesheet after the employer's established deadline for processing employee timesheets for a particular time period and the employer does not pay the employee within the 10-day period provided for in subsection (1), the employer may pay the employee the wages due in the ensuing pay period. An employer may not withhold payment of the employee's wages beyond the next ensuing pay period. If there is not an established time period or time when wages are due and payable, the pay period is presumed to be semimonthly in length.

I've had direct deposit at a couple of different jobs and have loved it. You will still get a pay stub statement or at least should have access to one on a computer. I have never had problems with the direct deposit at any time.

With direct deposit, your funds are usually available right away. Sometimes with a deposited check it is not. Check with your bank to confirm their policies.

thanks for all of the input I think I will just have them mail my check.. I don't have an account (never have in 20+ years always used cash.. ) and don't want one .. I don't want to have to pay a bank to let me get my money.. but thanks again..

My account is free. If all you use is check card then there are no transaction fees or check costs. Just ATM for cash. That is what I do. Never bought any checks since having the account.

If you have direct deposit that also means direct withdrawal and I know some people that have had a nasty surprise because of an unexpected withdrawal and it really was not their fault.It can cause problems.
I bet you vote Republican.A Democrat would not have cash.

Sometimes checks get lost via snail mail or delayed in transit.
Check out Community First Federal Credit Union. You can get free checking account with no fees charged. Direct deposit checks are available immediately and you can get an ATM debit card that can be used free at their ATM. Fees apply if you use it at another ATM. No need to have checks.
This is very convenient and have had no problems getting money.
Have used this service for about 20 years and have all my checks direct deposited there.

My second cousin knew a guy in Arkansas that put his check in a bank there run by the guy who had the General Store for 4 generations. Anyways, this carpetbagging democrat came to town and bought the bank and stole all his money. Just like that.

I will never, ever, give my hard earned money over to a welfare grabbing democrat no matter what this FDIC (Freaking Democrat In Charge)((only it ain't freaking)) supposedly guarantees.

Get yourself a good fireproof mattress and sleep on it. It's the best rest you'll ever have.
