The "no complaint filed" statement is suspect, to say the least. This was not the first time R S has been to court for this same complaint.

I'm guessing "signed complaints" in public nuisance matters are few and far between unless the person signing the complaint is a law enforcement officer, code enforcement officer/inspector, or city official such as the mayor.

It's probably understood that neighbors are reluctant to go "on the record" in complaint against their neighbor. They do have to keep living next to the person. This is why we have well-written ordinances/code and paid professionals to enforce them -- "It's not personal, it's my job."

A "signed complaint" is pretty much the same everywhere so it's meaning here is not ambiguous. Mr. Colombik was sworn, so I assume this is a truthful statement.

For those of us who live in the ghetto world, without the benefit of HOA's with gestapo "architectural committees" to do our dirty work for us ("It's not personal, it's my job."), signing a complaint is our only recourse against unacceptable behavior. The cops here (and most places) won't lift a finger for property/noise disputes unless they have one, and they have no problem telling you that. (Yes, I have signed several, when they were necessary.)

And yes, you can expect to get your tires slashed, your car keyed or some other CS action that cowards are so good at, after signing a complaint on them. You just have to make sure that doesn't happen or that it won't ever happen again. That's the "man-up" part of ghetto social engineering.

So, nobody answered my question.

Was Butch Grenz the guy who finally had the guts to drag Ship into court over the trash heap he's been occupying for 30 years? I'm just trying to get a cheap thrill out of the possible irony here.

If it's that easy, why wasn't this handled 30 years ago? Or 3 years ago? Maybe the ex-Mayor can tell why his efforts never had Ship begging a Judge to stay out of jail?

As for Mayor Whalen not doing anything you seem misinformed. Shipley even attempted to sue Whalen in federal court he was so upset about Whalen's attempts to enforce Miles City's public nuisance ordinance.

Here is some interesting commentary from the Billings Gazette website:

He's not destroyed. He's just changed. He's eccentric. He's still an extremely intelligent man filled with passion. Would I want him mad at me? No. Would I buy the house next door to him? No. Would I share a cup of coffee with him? Absolutely.

While visiting my parents this last September I drove by Ships on the way to the golf course. Still the same awe inspiring amount of "stuff." But, he was standing outsidethe door feeding scrap wood into a burn barrel that had to have been less than a foot from that
wood shingled building. If his place caught fire with who knows what
toxic junk, besides the vehicles, around half of Miles City would probably have to be evacuated.

I think he is trying.There has been improvement.I do not see people here clamboring over each other to go help him.Ok,why help him.What about clean up the neighborhood.It seems Ship has collected enough [email protected],I mean sh!t,wait I meant accumulation that it is hard for him to get rid of it.I know he does not want to part with anything,but it the right person talked to him he might be willing to,with a little planning ahead take some help on cleaning up his property around his house. I worked with a church onetime,they had people coming in a few times a week.They,I don`t know what they did but they got fed in the end.In one day,I,in cooperation with the Minister,transformed this bunch in to what is still known as My Homeless Army. There was heavy equipment for support but we cleaned up and and organized 11 acres in one day.When these guys got done and the bus picked them up they were scratched and bloody with their clothes torn and they were beat.I held up the bus and went in to the office and said I need some money,I got what I asked for immediately.I would have taken it out of my pay had they not.The bus took them back to the church for their feed.Some applied for and were given employment.They came for a free meal,they told me,several of them after that day,that was the best day they had ever had.As far as I know the Church still does this but we decided we were a commercial bussiness and it was better that they do deeds for individuals who need help and so I had to decline their requests to come once a week.I paid them $5 tip apiece if I remember right as they were working for the church and I could not pay them.Everyone of them did a days work except one.He stood clearly out of the way and was certainly in charge.I got him a dollar in his pocket even though he was in charge.

What you don't understand is that Rob does not consider his stuff junk or crap. He considers his yard an artistic celebration of his life and a tourist attraction for Miles City.

I understand that fully.I mentioned that I am sure he does not want to get rid of anything.You might go in to someone`s house and they have a picasso on the wall and think that should be taken down and a boar`s head that you stalked and killed in Africa,a magnificent trophy,and had stuffed put in it`s place.A friend of mine told me about a car that his dad had.He helped move it many times,through the sale of three houses even over the years.This guy`s dad was going to restore the car,it was so important to him,and it was a neat car by the way,but he had proposed to his wife in that car.When he died,this guy`s mom,one of the first things she said was get that car out of here.It got scrapped.I gave a piece of jewelry to a woman who would not be without it even in the shower, who had it stolen as she lay dying at age 39.That would mean a lot to me if I had it,but it probably got traded for some meth.So just because you think something has no worth,that is just your opinion,not that of the person who places value on it.I also said Shipley`s yard is full of sh!t and [email protected],give me a break.It is Sunday and I was just preaching a bit.

The order was signed by City Attorney Dan Rice on Jan. 8.

As for the trustee’s sale, Recontrust Company postponed today’s sale without stating a reason. The company handles the foreclosure process for lenders, and was handling the case for Bank of America.

The sale was to take place at the Custer County Courthouse. The sale was originally set for Nov. 30, 2012, but that date also was postponed.

According to a legal notice that appeared in the Miles City Star in 2012, the sale is the result of a default in the payment of a monthly installment that became due April 1 of 2012.

The notice said the lender is owed the unpaid principal balance of $65,051.29, along with the 7.75 percent interest, plus other fees and charges.

I wonder if NDJ is aware that they should place a -space- between each complete sentence.It is very aggravating to read their stupidity without them.

Anyhow, just popping in to say how much I love how ol' Butchy has to keep Rob away from him with a restraining order. Seems Rob is just a TERRIBLE nuisance to this community and our Mayor.

Sidenote: Kinda interesting that the Mayor can receive a restraining order against someone for such petty stuff, yet a close friend of mine cannot against a literally bat-poop insane woman who chooses to stalk her frequently, and has continued to do so for well over two years. Oh well, tax dollars well spent. Now then, who wants the best ribs in town?

I don't think you understand the gravity of the situation, Josh. I am NO fan of the mayor, but I think his actions are prudent. He has a responsibility to protect himself, his family, his businesses, and those at City Hall. Basically, because Butch has the same schedule as Amtrak (don't know where he is, when) Mr. Shipley legally has to stay clear of downtown. This is a good thing.

Eh, I could honestly care less where Rob is. However it isn't as hard to find Mr. Mayor as one would think. Look for his old truck, and you got 'em. Or, as one of my more distant family members did... drive your truck through the "sheetter" at the Boardwalk while drunk at 3am-ish. That'll find him.

Same old Same old for Robby. 24th of December was his deadline for cleaning up. Still not done, mayor gets order of protection, Robbie continues to wander around town. He faces no consequences. I understand the man has problems but, he just keeps thumbing his nose at Miles City.

Just wondering....

If the bank now owns the property enough to try and sell it, what's Rob's incentive to clean it up? Seems to me that proceeding to throw him in jail on the clean up order may pose some interesting legal issues over who is now responsible for the condition of the property.

I'm guessing a lawsuit may be why the bank canceled the sale?

Regardless, I predict more lawsuits for the Mayor and the City before the mess is gone. That is, if Rob has any dough left.

Local resident Rob Shipley’s appeal of a public nuisance conviction was dismissed because Shipley failed to appear at the hearing Thursday morning, according to a 16th District Court order.

District Judge Michael Hayworth made the order.

Judge Leroy Not Afraid had presided at the Nov. 25 City Court trial and found Shipley guilty of maintaining a public nuisance for the condition of his property at 603 S. Fourth St.

Hayworth’s dismissal order stated, “In light of the Defendant’s choice to fail to appear for Arraignment on the appeal the Defendant initiated, the appeal cannot proceed ... the Defendant’s appeal is dismissed.”

It went on to say the judgement of the City Court is reinstated and that Shipley must comply with the City Court judgement.

Not Afraid had sentenced Shipley to 90 days in jail and fined him $500. The judge suspended the jail time and $300 on the condition Shipley clean his yard in 30 days.

Not Afraid told Shipley if he failed to do so, or failed to do it according to Mayor Butch Grenz’s satisfaction, “I guarantee you, Mr. Shipley, that you will serve jail time and you will be billed at that time (for the city crews doing the work), if you are found in violation.”

Shipley had paid the $200.

Judge Not Afraid could not be reached for comment on the penalty phase before presstime.

Miles City Deputy Attorney Jeff Noble prosecuted the case. Shipley represented himself.

A trustee’s sale on the property, unrelated to the case, has been postponed several times.

If ol' robby boy can't keep his Golf Course front property clean so it doesn't look like a dump, he should be forced to do something about it one way or another. Hell, if I was his next door neighbor I would have issues with it and probably take a bobcat to his lawn. I don't want to look out my window and see a garbage dump next to my house.

no I don't hold grudges life is too short .. we all have our faults no one is perfect, so I don't know why everyone pretends to be ... "poor" in wrong context ..
Boatley is a smart guy he knows his limitations i am sure. I hope the case works out for Shipley and everyone else.

I hate to add to this craziness, but having been home this weekend and my mother's house being across the street, I have to say that mess is crazy! It's 10X as bad as it was when I was home 2 years ago. Something must be done!!

On another note, I was a little saddened by the condition of many many yards throughout town as I drove around.

Pride in the look of the back areas of the city seems hit or miss. The up-front places are beautiful as always!
