Miles City homicide...

Does anyone remember a homicide that occurred around 1980? Does anyone have any details? We were trying to remember events that had happened in Miles City, or to former Miles Citian's, and this was one that we had forgotten about. I seem to recall something about a cab driver, but I don't remember if a cab driver got killed or if there was a guy who used to be a cab driver here that murdered some people in California? Does this make any sense? Our curiousity is getting the best of us!

I vaguely remember this incidence. The killer's parents had lived in Miles City. He apparently came back to this area and murdered the cab driver on the road near the cementary. It was thought he holed up in the Pine Hills somewhere. I remember Ethel Hardesty telling me that someone during this time had broken in several cabins or summer homes and had taken food. As I recall he was later caught in California after murdering some one or some people and it came out that he had killed the cab driver in Miles Cityl

Etchemendy was the name I think. He was murdered by a couple of guys that went to prison. Maybe the chair too, or however we do it around these parts. Are we a lethal injections state? I know they used to hang people. On a field trip in high school, the jailer took us to the part of the jail where they used to carry out hangings and said that they quit the practice after a fat man's head came off. That's a rumor I wonder if there is truth to.

There was someone that got shot down at the Olive Bar about 1979 or 80. It sticks in my head that the guy that did the shootings last name was French? maybe. I remember their were a lot of people surpirsed that this guy would shoot someone.

Okay, here we go from a reliable source:

Etchemendy was killed by Vernon and Lester Kills On Top, with involvement from a woman named Diane Bull Coming. (There may have been a Billings Gazette story about her release from prison in the not too distant past.)

Cody Schreiber killed a cab drive in the the 1970's. Apparently he was sent to Warm Springs, walked away and was later accused of killing a roommate in California.

I don't know which you are thinking about, but those are my guesses.

There hasn't been a peculiar murder in MC for a while. The last few have involved meth-heads that I presume have drifted recently to the area. Porno Larry is really the last I remember and I believe his remains unsolved to this day.

I guess there is still plenty of scandal though. It's fortunate that "He" runs the city with such gusto. If "He" really is the police chief, I think "He" should have to grow a handlebar mustache and carry a six-shooter and double-barreled shotgun. Sounds to me like a story for Dateline and a chance to attract tourists.

Note - Please refer only to "Him" as "He," as his name is too sweet utter and causes pain and deafness to those who hear it. "He" warrents capitalization too, because "He'll" getcha.

Whatever happen to Cody Schreiber? His sister was a couple of years behind me in high school at Sacred Heart and Cody was in grade school. I can't seem to find any info on the internet on him. I assume he is in the pen in CA.

One would think Cody (the class clown btw.)is still in prison. From what I understand he and his roommate got into an argument (about a playboy centerfold poster.) Cody killed the roommate and when he couldn't fit his whole body into the hole he had dug,he just cut the head off.
This of course after having killed a man in Miles City, (Bill Moyer?)
been put into Warm Springs and walking away to CA. Scary!
There was a time Cody decided to get home by crossing the Yellowstone on a log, this so he wouldn't be late getting home. He was rescued sometime towards morning I think, on his way to Glendive.

Cody was a 7th or 8th grader when I started a SHGS as a 1st grader. He was one of the "big kids" that was half-way nice to me. I think he was a trombone player for Mr. Terhar(sp?)in the SHHS band. If I remember correctly he was also a fairly good basketball player.

It is sad how some people seem like they have everything going for themselves and then mess their lives up.

Marie Eddy was killed by her boyfriend in the late 80's early 90's. The same night a woman was found hanging in her bathroom. Her husband walked 10 blocks to the police station to report it. Was ruled "accidental death". NOT

My father claims to have been riding in the car behind the cab when the deed was done. Whether this is true or just something he liked to tell us when we were driving on Cemetery Road, I don't really know.

Come to think of it, he also told us once that one of the places where Lester & Vernon pulled over to beat Marty Etchemendy was just down the road from our house.

No doubt this was one of those "old-fashioned" parenting techniques I've heard so much about.

The other person that murdered someone in Miles City around 1980 was August White. He killed a fella from EMI and threw him off the tongue river bridge into the river. He did 25 years and was recently released. Now he is out and in Miles City. He dosn't seem to have any problem telling people about it either.

While we are on the subject of Miles City homocides...I am surprised that no one has mentioned the bludgeoning to death of Larry Kruthers (sp?)....Miles City's reknowned porn man. I heard a lot of talk, but (excuse me if I'm wrong)didn't his murder go unsolved as well?

For a sense of perspective, Tom, was showing me a newspaper with the Montana theater advertising the original Star Wars movie, which was May of 1977. On the front page was a picture and article about Cody Schreiber saying that he had escaped the mental institution and talked about a murder he committed in 1976. I think we might still have the article at the pawn shop if anybody is interested.

Does anybody have any information on the August Lee White murder?

Wasn't there a Marie Sparks that was killed by her husband? He shot her in her bathroom after she left him. Her boyfriend was there, too, I think?

The cab driver that was murdered back in the 1970's was DON MOYER. He was a very nice, quiet, family man. He liked to bowl and spend time with his family.

The last I heard, Cody Schreiber was killed while in prison in California some time after the murder he committed there.

The developmentally disabled man that was killed was not thrown off the Tongue River bridge. What really happened wasn't much different from that, but what actually happened was that his body was slipped into a hole in the ice just below 12 mile dam on the Tongue River. Divers had to be brought in to dive through the hole in the ice to recover the body.

I tried to find a picture of Schreiber or some way to find if he's alive, but all I get is an article from 1997 college newspaper. California gave up on showing their prisoner records, but I sure don't know why? Oh wait, I guess they still do, but I don't have time to go through all the phonebooks in California.

If it's just not funny, I'm trying to imply that California is a state full of criminals.

Did Cody escape out of the courtroom in MC and the deputies chase him on foot downtown. I think he was caught when he ran into a door someone was opening at store. I think he was outrunning the deputies barefooted. I may be wrong on it being Cody but it seems to me someone did escape like this.

He escaped the mental hospital at Warm Springs. Sounds like less of an escape and more of a stand up and walk away.

Cody Schreiber did escape from the Custer County Jail. He was in the process of transport from his cell to court and ran from the officers up the stairs of the EOC and out the door. A Miles City Police Officer just happened to drive up when Schreiber ran out across the parking lot behind the Courthouse. The Police Officer gave chase. Schreiber was barefoot. The chase took place for several blocks through a store and ended over by the old Park Theatre. A citizen stepped in front of Schreiber and slowed him down and the Police Officer caught and handcuffed him. He was taken back to jail after his brief freedom.

He walked away from Warm Springs.

The night Mr. Moyer died, I along with 4 unnamed friends came upon the scene right after it happened. There were 2 other people already there, both of them immediate neighbors, one of them a teacher. We couldn't figure out why the cab was backward in the ditch, with someone lying in the road. The teacher didn't want to tell us what was going on, finally did, and you never saw people move so fast in your life. I was driving and got to the nearest phone to call my mom and warn her to lock down the house. Of course she thought I was kidding, because of all the pranks I had pulled....
Couple days later while checking my trot line in the Tongue I noticed where someone had crossed from the other side. Notified the fuzz but no one came to investigate.
Bridgier ask you dad who was driving that night.
Maybe it's not a Deadman Road tale...

Does any one remember the day the Air Force Plane crashed at the Airport? Wonder what became of the 6 surviving crew???

I remember back in the early 50's when an Air Force plane crashed up near the airport. Several of the crew bailed out prior to the plane crashing. In 1965 I had just returned to Connecticut from a visit in Miles City. I was working as a Sgt. at a County jail and on my first day back at work I was talking to the Sheriff and he asked where I had been on vacation. I told him that I had gone back to the town where I was born, Miles City, Montana. There was an inmate standing nearby and he asked if I had ever worked in a hotel in Miles City. I replied that I had worked in both the Miles Howard and Milligan. He said, "I thought you looked familiar. I was one of the guys who bailed out of the plane that crashed." He was doing time for breaking and entering. Now you know what happened to at least one of the guys from that plane. Incidently, David, we lived next door to John and Kathy Harasymczuk and were good friends. I last saw John when he visited us in Florida about 10 years ago.

Out of respect, for his step parrents, (he was adopted) I won't say much about Cody here. He lived 2 houses down the street from me during our childhood. I was never aware of a sister, I suppose it's possible, but doutfull that he would have known her if he had one. Cody's entire life is something I will always be interested in. On May 13, 1944, a B-24 bomber crashed at the airport. There were 6 survivors. They did not bail out, but one fellow pulled his rip chord and rolled himself up in his chute. Those who got to the scene first thought he had bailed out. I have had extensive conversations with that fellow

About 1955 a US Air Force C-119 blew an engine, while carrying paratroopers. They bailed out and landed all over MC and the surrounding area. The plane landed w/o incident.

On September 22, 1953, while I was in CCHS math class, a C-46 took off from the airport with a load of soldiers on the way home from Korea. An engine caught fire and the plane came over MC burning. The pilot made it to a wheat field across the highway from the airport and crash landed. No one was hurt, nor did anyone bail out.

In 1972 there happened upon the scene a young African American fellow who made a few friends around Miles City. One night he threw a rock or a brick through the Jewelry store window accross the street from where Sullivans Furniture is located. (Manns Jewlery)? He was caught and booked into the County jail and when the report on him came back it was discovered that he had killed a cab driver in SanDiego. He seemed like a pretty nice guy..guess ya never know..

Regarding the August White murder of the guy from EMI - I don't know why I remember this, but I seem to recall the man he killed was named "Dallas" something-or-other...I remember as a young man, being somewhat stunned when I saw the article because the story went that "Dallas" had some valuable rare coin collection that White wanted to take from him, and he refused and was killed for it...of course, I may be mistaken, but that's the way I recall the story. Other than that, It's a sad fact of life that murder happens even in a place like Miles City that's thought to be a safe place to raise a family. I think it's still a safe place - there are just a small number of such instances compared to other places. Still, it's sad that it happens at all.

Marie Sparks was killed by her estranged husband Darrell Sparks in her boyfriend's apartment. Darrell Sparks is doing life at MSP. You can look up any offender on record on the Montana Department of Corrections website.

A sad footnote to contribute to this otherwise light hearted thread, Darrell Sparks had been stalking her since she left him and filed for divorce. He learned of her whereabouts by coercing it out of their young son who was of pre-school age at the time.

People do time in prision for comitting a felony. Once the term is up, they should be able to go on with their lives. People make mistakes. He made his biggest mistake at the invincible age of 17. He just got out nearly 30 years later. He missed out on everything, Like he told me, one minute your whole life is in front of you, you seem invincible, and the next monent you are staring at an old man in the mirror just trying to make it. Granted, he can not undo the things he did. Someone sounded suprised he is willing to talk about it. Should he just pretend it never happened? C'mon!!!!! He is not bragging about it. I dont mind someone asking me about my Parkinsons Disease. Knowledge IS power. Talking about something not understood helps the healing process. All I am saying is he made a mistake. He gave his pound of flesh and then some. He has done his time accroding to our laws. I think he has earned a chance.

I recall the same being told by family members to me, back when you were a little kid, so as far as I know that actually is true -- something along the lines that he was the first driver that came upon the scene and found the cab driver dead in the road. Or something like that.

As far as Etchemendy and "just down the road from our house" goes ... I don't know if that is true or not.

If I recall correctly, and I may not, I think there was a pretty detailed description of what happened that was eventually published in the paper... with the end result of him ending up over the border into Wyoming.

I don't remember what was said about the trip down... although I vaguely recall it all starting at somewhere like the Golden Saloon parking lot or something like that.

What was Cody Schreibers' sisters name, do you recall?
By the way Cody is still in prison in California. He stated that Satan had entered him at the age of 5. He was obsessed with dead animals when he was little. He broke his puppy's back leg just to do it. I heard that he tried killing his youngest sister in her crib several times, and used lawn shears to cut her head open, and would try to smother her in her sleep. So his real mother had to give him up for adoption in Billings Montana in 1959, thats when the Schreibers adopted him. Cody was always beaten by his real father who has sence passed away. What is weird is that the father used to kill cab drivers and rob them in the State of Kansas and Missouri. He was never cought. how ironic!! is being a murder genetic?

Since someone brought this thread back to life I figured I'd correct the mistake. Marie Sparks (maiden name Eddy) was killed by her husband Darrell in Nov 92. However her son was not of preschool age and did not reveal her whereabouts to her estranged husband. I was 12 and was home asleep when I woke to the sheriff at the door around 2am and my father knew where my mother was due to her car. It's amazing how folks cite mistakes with such detail.

It was Dallas Haley who was thrown into 12 mile. Gary Dent was the police officer that ran down Cody Schreiber and caught him in front of the Park Theater. Another double homicide I remember was at Kinsey Mt. about 12 to 15 years ago. The exbrother in-law of a Kinsey resident broke into his ex sister in-laws home and shot and killed her and her youngest son. Her husband, Claude was also shot but survived the gun blast to his stomach. The perpetrator, I believe his last name was Race, also set the house on fire. The oldest son ran to the neighbors with severe burns covering his body. Race escaped by apparently crossing the Yellowstone river on foot and was captured later in the week on a beach in Corpus Christi Texas. Does anyone else recall this incident? No idea how the survivers are doing today.

Legal Record is a little ambiguous. Is it 2 counts per on the 20th and 21st of Oct '95 for a total of four or 2 counts total? In any event, it shows "life" for a net sentence on all homicide convictions.

Also, latest status pages on Sparks shows 40yrs for mitigated deliberate homicide, 40 years for burglary and 10 years for a weapon. I can't tell if the sentences are concurrent or consecutive

Late 60s early 70s Jan Smith was shot at the Alta Club.Alise Anderson shot and killed on garland street in the late 90s I believe. Anyone recall those two homicides.

Dave it's hard to say. If they plead guilty to all they usually run concurrent. If it goes to trial and found guilty usually runs consecutive. If it goes to trial and they are sentenced to a large number of years the judge usually makes it concurrent.
I think in his case it is probably concurrent.

It was Jeff Wyman who was shot and burned by his uncle in Kinsey. It was on 10/21/95. His brother and mother didn't make it but his dad and sister did. I think she still lives on Atlantic across from the depot. Last I heard Jeff was somewhere warm on the east coast. He was a huge NASCAR fan and would often take my son out on the roads in Kinsey just like Dale Sr. would do it as he said. He even had his car painted with a big 3 on it.

We had gone with Jeff out to the house a few times and it was just so heartbreaking knowing what happened there. He was not shy about talking about it and was sort of a hero to my son. Jeff would take him out in kinsey and go fishing for catfish. I remember that was some of the best times for my son. So excited to come home and cook his fish that they just caught. I would love to get back into contact with Jeff and see how he is doing.

Yes, Denny. My mother Alise Cagle was killed in our front yard in July 1995, same year as the Wymans. I remember it was just a really bad year for the community. Her perpetrator Karley Lindstrom claimed to have accidentally shot her. He received 15 years for criminal endangerment, and only had to serve about 5 if I remember correctly. He's been out for some time.

Um... I dont mean to bring this thread into the light again but wow... And does Mr.White know that he's on here. I had no clue he had committed a crime like this and I know him pretty well and think hes a great guy. I dont think its right that links are posted about people that are still residing in MC and trying to live there lives after doing time. I just happened to stumble upon this thread and it doesnt make me look at Mr.White any different but its still not right in my opinion to be posting links to his record and photo on a public site thats dedicated to small town MC. Its a small town and you could make his life harder after all hes been thru. I just dont think its right. I really wander about a lot of the ppl in MC. Its suppose to be a small town with NICE, UNDERSTANDING and RESPECTFUL folks. Ive mainly seen nothing but gossip, bad mouthing, rude, immorale and flat out unethical people. Its sad. Im extremely happy I no longer reside in Miles City.

Tempest, I didn't see anything in the posts that was extremely rude or gossipy or judgemental in these threads. I think it is good to recall things that happened in our community in the past, good or bad. I, for one, feel proud of our community that we rarely experience these types of occurrences and that we have the courage to talk about and remember the victims, their families and the history of it all. If you're so glad to be out of this awful little town, why do you torture yourself visiting this site?

My IQ begs to differ with anyone that makes remarks towards my intelligence so thats just a waste of my time to dignify such remarks with a reply back other than, "Everytime you point your finger you have three pointing back at yourself". I never stated that anyone was being rude or judgemental in this particular thread (up until this point). I was merely stating that I dont THINK IT'S RIGHT (Im entitled to my own opinion) to talk about people that are really trying hard to live their lives correctly after paying for a heinous crime. Atleast, not in such a SMALL town. Everyone literally knows just about EVERYONE in MC. Yes what he did was wrong. Im not argueing that BUT he spent close to 30 years in jail for what he did and he's a decent citizen now who should be left alone and not be spoken about. Its more of a sympathetic vote from me. I have sympathy for the man that lost his life and I have sympathy for the man that lost the majority of his life because it was spent behind bars. As for the digs at some residents of MC that was me just being disgruntled at posts Ive seen on this site where people say completely outrageous, rude, unempathetic, unethical and flat out mean things like a twelve year old child with an adults vocabulary would. Its just not right. Its sad that some people are scared to join in on this site to post their honest opinions in fear of being ridiculed. Luckily I couldnt care less about being ridiculed online. Id love to see someone call me an idiot in person. Its really sad that some people are abusing this site to make themselves feel better. I wont name names, you all know who you are. Good day.

Interesting thread. I am always glad to know if there are violent criminals/sex offenders who live in my neighborhood (around Montana, Leighton Boulevard, WMS)!
As far as the Etchemendy murder goes: Didn't the whole thing start out at the Alta Saloon?
Also: Let's not forget about the most recent homicides (Woods and Rickett).
It is good to know your town's history (good or bad)...so thanks for this thread.

The Etchemendy murder started out at the Alta and ended up down around Wyoming, or wherever, in disturbing fashion. I knew him before his demise. The Indians who did it are I believe at least life in prison, if not on death row.

James A. Sidebotham, chief investigator for the Orange County Sheriff's Department in the Randy Kraft serial murder case, still hears from colleagues about Cody Schreiber.

Schreiber was suspected of killing his Mission Viejo roommate six years ago. During an interrogation that lasted nearly two hours, Schreiber told two investigators about burglars breaking in and killing the roommate. He talked and talked and talked. But he steadfastly denied killing anyone.

Sidebotham was monitoring the questioning from another room. When it ended, he talked briefly with Schreiber at a water cooler.

"You ready to give it up?" Sidebotham asked.

Schreiber looked at him.

Let's talk, Schreiber said.

Grisly Details Given

Alone with Sidebotham, Schreiber confessed. Sometimes it helps just to let it all out, Sidebotham suggested.

So he did. Schreiber told in grisly detail, before a hidden video camera, how he decapitated his roommate and buried the body parts. Sidebotham later allowed Schreiber to be the director and star of his own videotape, re-creating the crime for investigators.

The videotaped confession and the video re-creation of the crime were key to the prosecution's case against Schreiber who was convicted of first-degree murder.

"It takes a unique individual to get a cold-blooded killer to open up like that," said Deputy Dist. Atty. Bryan F. Brown, one of the prosecutors in the Kraft case and an unabashed admirer of the 52-year-old investigator. "Sidebotham is the kind of cop you would confess to. It's like telling your grandfather."

The rail-thin Sidebotham can manage a smile about the Schreiber story. But after 27 years in law enforcement, most of his stories are about the anguish of victims' families, murders with no clues and the tedious task of going to court once a suspect is caught.

In the Kraft case, prosecutors wonder if Sidebotham hasn't been forced to perform beyond the call of duty. He has been on the witness stand 18 days--and returns again today--in a pretrial search warrant hearing. No one in Orange County legal circles can recall a police officer testifying longer.

Kraft, accused of killing 37 young men between 1971 and 1983, is challenging the legality of the search of his car and three searches of his Long Beach home. Sidebotham led a team of investigators who seized several thousand items of evidence in those searches.

Kraft's attorneys say Sidebotham overstepped his bounds.

Hi,
I think the homicide at the Olive Hotel was in 1973, if memory serves me correctly. We live in WA and were home for my Dad's funeral, which was in late Feb. and early March. Bill French was a long-time neighbor and we knew him well.My Mom said he'd gone downtown to collect a large amount of money ($25,000-50,000) and the victim smirked and basically told Bill he had no intention of paying him back.

I don't remember this at all, but I was just a dumb freshman or sophomore. Anyone know what these men did for a living? What kind of deal they might have had that involved so much money? That would probably be close to the cost of a nice home these days...

If memory serves (and it doesn't serve very well these days) the argument was over coal leases or a land deal of some sort. French thought Fleming was screwing him on the deal so he popped him. I didn't know either one of them, but I did know Joe Hennessey who handled the appeal along with Ken Wilson. Joe and I had several conversations about his involvement with the French case in the late 1970's.

An interesting part of this particular case was, at that time, defense attorneys around the Country were trying to build some case law for the "diminished capacity" defense. Hennessey told me that was one of the objectives and he thought the circumstances involving Bill French might be a good test case in an appeal.

Apparently the Court wasn't sold on it at that time. I do remember that in the late '70's and '80's there were a number of murder cases tried with a "diminished capacity" argument and some of the defense attorneys were successful in obtaining reduced sentences.

No matter what larry was he deserves justice to his death right..Seems like a lot of killings in the 80s and 90s.. wierd..

This is so interesting. I was in grade school when Janet Smith was killed at the Alta club. Being so young I guess I never knew or never asked if anybody knew why.

On the evening of October 21, 1995, Carl Race went to the home of his estranged wife's sister Rita Wymann and her family, husband Claude and sons Jeff & ____ in Kinsey, Montana, and shot all four people living there. He then poured an accelerant, believed to be gasoline, on the victims' bodies and set them on fire. Jeff managed to escape to a neighbor's house, after being shot, and Claude managed to escape after he had been set on fire. Claude and Jeff survived Race's attack. Rita and son ______ died as a result of their gunshot wounds and burns. The two survivors, who had known Race for over twenty years, identified him as the assailant. Race was arrested in Texas a week later and was extradited to Montana on two charges of deliberate homicide, two charges of attempted deliberate homicide, aggravated burglary, and arson. At the State's request, the court ordered a psychiatric examination to determine whether Race was capable of standing trial and whether he was capable of possessing the requisite mental state at the time of the crimes. After a two-day examination, the psychiatrist, Dr. Stratford, concluded that Race was competent to stand trial and that he suffered from no mental disease or defect. Stratford further stated his belief that Race had the capacity to act purposely or knowingly and to appreciate the criminality of his conduct at the time of the crimes charged.
In May 1996, Race and the State entered a plea agreement by which Race pled guilty to two counts of deliberate homicide and two counts of attempted deliberate homicide. The State agreed to drop the charges of arson and aggravated burglary and not to recommend a sentence of death.

Mission Viejo Couple Accepts $300,000 Out of Court : Murder Victim's Parents Settle With State of Montana

A Mission Viejo couple whose son was decapitated by a man who had escaped from a Montana mental hospital decided to accept a $300,000 out-of-court settlement from that state, their attorney said Tuesday.

Myron G. Cohn, who represented George A. and Irene Schubert in the case against the State of Montana, said the couple could have probably won more money had they decided to go to court.

The Schuberts, who declined to discuss the case, sued Montana for negligence in not providing better security for Cody Leo Schreiber, who escaped from the Warm Springs Mental Institution in 1977. Almost five years later, on Oct. 16, 1982, Schreiber decapitated Dennis James Schubert, 24, and buried the body in the backyard of the house they shared in Mission Viejo.

"It would have been pretty traumatic for them to go through it again," Cohn said. "There was a lot of anguish involved (in the decision to settle out of court)."

Schreiber, now 30, had been committed to the Montana mental institution after being found not guilty by reason of insanity in the shooting and stabbing death of a cab driver. He is now serving a 25-year sentence at Folsom Prison for Schubert's murder.

Clayton Herron, an attorney for the Montana Department of Administration's insurance and legal division, said the $300,000 was the maximum the Schuberts could have received from the state. But he also said the couple had a strong case and could have won much more had they chosen to go to trial.

"We felt it was very possible that a jury would have found negligence on our part, and a jury could have awarded them anywhere in the millions," Herron said from Helena, Mont.

The Montana official also said that other litigants are challenging the state's $300,000 maximum settlement on constitutional grounds and that this was another reason the state was anxious to settle with the Schuberts.
